The FDCPA is a federal law that protects consumers from abusive, unfair, and deceptive debt collection practices. These are not suggestions. They are legal requirements that RSH & Associates is bound by. If you believe we have violated any of these rights, you have the right to take legal action.

The Right to Validation

You can request written verification of the debt within 30 days of receiving our first notice. We must stop collection activity until we provide it.

The Right to Dispute

If you believe the debt is not yours or the amount is wrong, you can dispute it in writing. We must investigate and respond before continuing collection.

The Right to Stop Contact

You can send us a written request to stop contacting you. We must honor it. The underlying debt still exists and the original creditor may still contact you.

Protected Hours

We may not contact you before 8 AM or after 9 PM in your time zone. We may not call you at work if you tell us your employer disapproves.

No Harassment or Abuse

We are prohibited from using threats, obscene language, repeated calls intended to annoy, or any form of harassment. No exceptions.

No False Statements

We cannot misrepresent the amount owed, claim to be attorneys or government officials, or threaten legal action we do not intend to take.

Attorney Representation

If you have an attorney representing you, tell us. We must communicate only with your attorney and not contact you directly.

The Right to Sue

If we violate the FDCPA, you may sue us in state or federal court within one year of the violation, and may be entitled to actual and statutory damages.

Why is RSH & Associates contacting me?

RSH & Associates is a licensed, third-party collection agency. A business or healthcare provider you have a balance with has hired us to assist in recovering that balance. We are authorized to work with you on their behalf to resolve the account.

How do I know this is legitimate?

You have the right to request written verification of any debt. Contact us and we will provide the name of the original creditor, the amount owed, and the account details. You can also look us up with the Kansas Secretary of State or contact the CFPB.

What if I cannot afford to pay the full balance?

We offer several options. You can set up a payment plan, request a settlement for less than the full amount, or discuss hardship options. We want to work with you, not against you. Call us or use the payment portal to explore your options.

What is a settlement offer?

A settlement is an agreement to resolve your account by paying less than the full balance owed. When available, settlement options are shown in our notices and in the online payment portal. Settlements must typically be paid in a lump sum.

Will this affect my credit?

Collection accounts may be reported to credit bureaus. Resolving your account by paying in full, settling, or entering a payment arrangement is typically the first step toward improving your credit situation. Consult a credit counselor for personalized advice.

What is the statute of limitations on my debt?

The statute of limitations on debt varies by state and debt type. In Kansas it is generally 5 years for written contracts. Even after the statute expires, you may still owe the debt. The statute simply limits the time a collector can sue. The CFPB has more information.

What if the debt is not mine?

Disputes happen. If you believe you do not owe this debt, or the amount is incorrect, submit a written dispute within 30 days of our first notice. We are required by law to stop collection activity and investigate before we can continue.

What happens after I pay?

Once payment is received and processed, we notify the original creditor. If the account was reported to credit bureaus, the status will be updated to reflect that it has been paid or settled. Receipts are available through the payment portal.
